QuikkEats Terms of Service
1. Platform Role & Marketplace Model
QuikkEats is an online marketplace and coordination service connecting consumers with independent restaurant and food merchant partners, as well as independent third-party delivery couriers in Juba, South Sudan. These terms supplement the general Quikk Terms of Service.
Merchant Responsibility: Quikk is not a restaurant, caterer, or food preparation facility. Food preparation, packaging, freshness, allergen accuracy, and health standard compliance are the sole responsibility of the independent merchant from whom you purchase.
2. Order Fulfillment Models: Delivery vs Pickup
Depending on the merchant setup, QuikkEats supports two distinct ordering workflows:
- Delivery Orders: You place an order through the app. The merchant prepares the meal, packages it securely, and hands it to an independent courier who transports it to your specified delivery address in Juba.
- Self-Pickup Orders: You place an order through the app and select "Pickup". The merchant prepares your order, and you personally collect it from the merchant's physical restaurant location. No delivery courier is dispatched.
3. Cash on Delivery (COD) & Cash on Pickup Settlement
All transactions on QuikkEats are settled in physical cash in South Sudanese Pounds (SSP):
- Cash on Delivery (COD): You must have physical cash available when the courier arrives at your location. You hand the exact order total (including food cost and delivery fee) in cash to the courier. The courier reconciles change if needed.
- Cash on Pickup: You pay the merchant directly across their counter in physical cash when collecting your order.
- No Digital Card or Wallet Payments: Quikk does not process debit/credit cards, mobile money wallets, or stored platform balances.
- Payment Obligation: Placing a food order constitutes an unconditional commitment to receive and pay for the order in cash upon arrival. Ordering food and deliberately refusing cash payment upon arrival violates our Community Guidelines and results in permanent account suspension and potential referral to authorities for fraud.
4. Kitchen Preparation, Dispatch & Delivery Handoff
Merchants make every effort to prepare meals within estimated timeframes. Couriers make every reasonable effort to deliver quickly given local Juba traffic and road conditions.
- Accurate Delivery Addresses: You must provide an accurate drop-off description, identifiable landmark, and reachable contact telephone number.
- Courier Arrival & Waiting Window: When the courier arrives, they will attempt to contact you via telephone. If you fail to respond or meet the courier within ten (10) minutes of arrival, the courier may mark the order undeliverable. You remain liable for the cost of prepared meals in such instances.
- Tamper Seals: Inspect your meal packaging at handoff. If a package seal has clearly been broken or tampered with prior to receipt, notify Quikk Support immediately.
4A. Regulated & Age-Restricted Goods (Alcohol, Tobacco, Medicines)
While QuikkEats primarily coordinates prepared restaurant meals and everyday grocery deliveries, certain participating merchants may offer regulated merchandise where legally authorized in Juba. All such products are strictly governed by our 18+ eligibility policy and South Sudanese regulatory frameworks.
Product Classification
- Generally Permitted Goods: Standard cooked meals, non-alcoholic drinks, pastries, bakery goods, and general consumer packaged goods.
- Alcoholic Beverages (Beer, Wine, Spirits):
- Customers must be at least 18 years of age (or older if statutory minimum drinking age exceeds 18) to order or receive alcohol [LEGAL REVIEW REQUIRED — SOUTH SUDAN].
- Merchant partners remain strictly and solely responsible for maintaining valid liquor licensing, conforming with municipal alcohol sale permits, and observing restricted trading hours.
- Couriers must verify that the recipient is an adult of legal age upon delivery handoff. If the recipient appears under age or cannot present valid photo ID, handoff must be refused.
- Delivery will not knowingly be made to any individual who is intoxicated or unable to receive the order safely.
- Quikk reserves the absolute right to restrict alcohol delivery availability by geographic zone, time of day, or merchant tier.
- Tobacco & Cigarette Products:
- Available only where legally permitted under South Sudanese law.
- Restricted strictly to adult recipients (18+). Valid proof of age may be demanded at handoff.
- Merchants are solely responsible for ensuring tobacco listings comply with packaging, warning, and licensing laws.
- Couriers are instructed to refuse handoff if recipient age cannot be confirmed.
- Quikk reserves the right to prohibit specific tobacco, nicotine, or e-cigarette categories at any time.
- Medicines & Health Supplies:
- Ordinary Health/Wellness Goods: Permitted general retail health items, bandages, supplements, and personal care supplies may be ordered normally.
- Retail Over-the-Counter Medicines: May be sold and delivered only by authorized licensed pharmacies holding valid municipal and national pharmacy licenses [LEGAL REVIEW REQUIRED — PHARMACY/MEDICINE SALES].
- Prescription Medications Strictly Controlled: Quikk does NOT permit the unrestricted listing, sale, or informal delivery of prescription-only medicines, controlled pharmaceuticals, or narcotics. Partner pharmacies are solely responsible for valid doctor prescriptions, required dispensing pharmacist involvement, drug authenticity, and statutory storage standards.
- Other Age-Restricted & Adult Merchandise:
- May be listed only where the item is lawful, the merchant is legally authorized to retail it, Quikk has explicitly approved the category, and recipient age verification (18+) is confirmed.
- Unlawful, unlicensed, counterfeit, or prohibited adult products remain strictly barred.
Age Verification & Mandatory Refusal Protocol
For any order containing alcohol, tobacco, medicines, or age-restricted goods:
- The recipient must be physically present at the delivery location; orders cannot be dropped unattended.
- The courier or merchant has the legal authority and duty to inspect a valid government photo ID verifying the recipient is 18 years of age or older.
- If the recipient refuses or fails to produce valid identification, or is suspected of receiving goods on behalf of minors, the courier MUST refuse delivery.
- Refused restricted orders are returned or handled in accordance with operational procedures, and the customer remains responsible for delivery and cancellation fees.
5. Order Cancellations & Non-Refundability
Due to the perishable nature of prepared food:
- Pre-Preparation Cancellations: You may cancel an order free of penalty through the app ONLY if the merchant has not yet accepted or started preparing the order.
- Post-Preparation Cancellations Prohibited: Once the restaurant begins cooking or assembling your order, the order cannot be canceled, and the full cash payment obligation remains in effect.
- No Electronic Refund Mechanisms: Because payments are made in physical cash at delivery, there are no credit card reversals, automated in-app credits, or chargebacks. For damaged, missing, or incorrect items, report the issue through the app within 2 hours of delivery for mediation between you and the restaurant.
6. Food Safety, Ingredients & Allergen Disclaimers
Merchants provide menu item descriptions and ingredient lists. However:
- Quikk cannot guarantee that any food item is free of specific allergens (including peanuts, gluten, dairy, seafood, or sesame) or prepared in a specialized allergen-free environment.
- If you have severe dietary allergies or restrictions, you must contact the restaurant directly before placing your order to confirm ingredients.
- Quikk disclaims any liability for foodborne illness, adverse allergic reactions, or dietary incompatibilities arising from merchant food preparation.
7. Menu Pricing & Inquiries
Menu prices are set directly by partner restaurants and may differ from dine-in or counter prices. Merchants are solely responsible for ensuring price accuracy in the QuikkEats catalog.
