Driver & Courier Agreement

Direct Cash Earnings Notice: Quikk operates on a cash-first model. Drivers and couriers keep 100% of cash collected from passengers and customers at the moment of trip or delivery completion. Platform service fees are reconciled periodically via agreed cash settlement mechanisms. Quikk does not process weekly automated direct deposits or digital wallet transfers during launch.

1. Independent Contractor Relationship

This Driver & Courier Agreement ("Agreement") governs your engagement as an independent service provider on the Quikk platform (QuikkRide and QuikkEats) in Juba, South Sudan.

Strict Contractor Status: You acknowledge and agree that your relationship with Quikk is that of an independent contractor and not an employee, worker, agent, partner, or joint venturer. Nothing in this Agreement creates an employment relationship under the South Sudan Labour Act or other employment legislation LEGAL REVIEW REQUIRED.

You retain complete autonomy to decide when, where, and how long you log into the driver application, and whether you accept, reject, or ignore incoming dispatch requests.

2. Driver & Courier Eligibility Requirements

To register and maintain an active driver or delivery account, you must satisfy and maintain the following criteria:

  • Minimum Age: Be at least eighteen (18) years of age.
  • Valid Driver's License: Hold a valid, non-expired driving permit issued by the Republic of South Sudan appropriate for the vehicle class operated (Boda motorcycle, Tuk-Tuk, or passenger car) LEGAL REVIEW REQUIRED.
  • Vehicle Documentation: Provide proof of valid vehicle ownership, logbook registration, roadworthiness certificate, and third-party statutory vehicle insurance where mandated by local law.
  • Identity Verification: Complete in-person identity verification at Quikk's Juba partner hub by presenting your national ID card or passport.

3. Cash Fare Collection & Take-Home Earnings

All driver earnings operate on a physical cash basis:

  • Instant In-Person Cash Settlement: Upon completing each ride or food delivery, you collect the total trip fare or delivery charge directly from the customer in physical cash (South Sudanese Pounds).
  • Change Obligations: You are responsible for carrying reasonable small denominations of physical cash to provide accurate change to passengers and delivery customers.
  • Fare Adherence: You must strictly adhere to the fare amount calculated by the application. You are strictly forbidden from inflating fares, demanding arbitrary off-app tips, or extorting extra cash beyond calculated rates.

4. Platform Service Fees & Cash Reconciliation

In exchange for technology access, GPS dispatch, and marketplace connectivity, you agree to pay Quikk a platform service fee (commission) on completed bookings:

  • The applicable service fee percentage is disclosed in your driver onboarding documentation.
  • Because you collect 100% of cash fares directly from customers, accrued platform service fees are tracked as an outstanding balance in your driver profile.
  • Periodic Cash Settlement: You agree to remit accumulated platform service fees to Quikk's designated Juba operational hubs or through authorized agent channels on an agreed periodic schedule (e.g., weekly or upon reaching an accrued fee threshold) LEGAL REVIEW REQUIRED.
  • Failure to remit outstanding platform fees within required timeframes may result in temporary dispatch restriction until balances are settled.

5. Driving, Riding & Equipment Standards

You agree to uphold high safety and vehicle standards at all times while online:

  • Helmet Provision (Boda-Boda): Motorcycle riders must provide a clean, securely fitting helmet for their passenger and wear a helmet themselves at all times.
  • Passenger Limits: Never carry more than one passenger on a motorcycle. Adhere to seating limits in Tuk-Tuks and motorcars.
  • Zero Tolerance on Impairment: Operating a vehicle while under the influence of alcohol, miraa/khat, narcotics, or intoxicating substances results in immediate permanent blacklisting and police notification.
  • Respectful Conduct: Maintain civil, professional interactions. Harassment, verbal abuse, or aggressive behavior toward passengers, restaurant staff, or the public will not be tolerated.

5A. Delivery Procedures for Regulated & Age-Restricted Goods

Independent couriers and drivers handling orders containing regulated or age-restricted items (including alcoholic beverages, tobacco products, or pharmacy goods) must strictly observe the following mandatory delivery protocols:

Mandatory In-Person Recipient Handoff

  • Physical Recipient Presence: Restricted deliveries must NEVER be left unattended, placed outside a gate, or handed to an unknown bystander. Deliveries must be completed directly to the named ordering customer or an adult designated recipient.
  • Physical Age Verification: Couriers must inspect a valid, unexpired government-issued photo ID (Passport or South Sudanese National ID) confirming the recipient is at least eighteen (18) years of age before handing over age-restricted goods.
  • Strict Prohibition Against Minors: Couriers must never knowingly deliver or hand over alcoholic beverages, tobacco/cigarettes, or restricted items to any person under eighteen (18) years of age, or to an adult suspected of purchasing on behalf of minors.
  • Intoxication Assessment: Couriers must refuse handoff of alcoholic beverages if the recipient displays signs of severe behavioral intoxication or erratic aggression.

Mandatory Refusal & Operational Procedure

If the recipient cannot produce acceptable proof of age, refuses inspection, is an unaccompanied minor, or is unavailable:

  1. The courier must politely refuse handoff and cancel the completion of the delivery in the app.
  2. The courier must immediately contact Quikk Dispatch / Support to log the refusal reason ("Underage / Age Verification Failed").
  3. The restricted goods must be safely handled, returned to the originating merchant, or routed according to Quikk operational procedures [RESTRICTED DELIVERY SOP REQUIRED].
  4. Couriers will receive agreed return trip compensation according to platform delivery rate cards when following mandatory safety refusal procedures.

6. Operating Expenses, Taxes & Vehicle Maintenance

As an independent contractor:

  • You are solely responsible for all costs of operation, including fuel, tires, oil, repairs, mobile phone equipment, cellular data subscriptions, and vehicle maintenance.
  • You are exclusively responsible for assessing and remitting any personal income taxes, municipal trading levies, or personal contributions applicable to your earnings under South Sudanese tax law LEGAL REVIEW REQUIRED.
  • Quikk does not provide private health, personal accident, or property insurance coverage for independent drivers during launch. Drivers must ensure they maintain required statutory third-party road insurance.

7. Suspension, Deactivation & Dispute Mediation

Quikk may suspend or terminate your platform access for serious safety breaches, low performance ratings, fraud (such as fictitious trip generation), refusal to honor cash change, or criminal conduct. You may deactivate your driver account at any time by clearing any outstanding platform fee balance.
