General Terms of Service
Important Launch Context: Quikk launches in Juba, South Sudan as a cash-first mobility and order-matching platform. All ride fares, meal purchases, and delivery fees are payable in physical cash directly between users and service providers or merchants. There are no digital wallets, card transactions, or automated payment processing services active at launch.
1. Agreement to Terms
These General Terms of Service ("Terms") constitute a legally binding agreement between you and Quikk, operating as a Rare Inc. company ("Quikk", "we", "us", or "our"), governing your access to and use of our websites, mobile applications, and technology platforms in Juba, South Sudan (the "Services").
By registering for an account, accessing our public web properties, submitting partner applications, or booking trips/orders, you agree to comply with and be bound by these Terms. If you do not agree, you must immediately refrain from accessing or using the Services.
2. Minimum Age Eligibility (18+ Platform) & Account Responsibilities
Quikk is strictly an 18+ platform. You must be at least eighteen (18) years of age to create, register, or independently operate a customer, driver, courier, or merchant account on Quikk.
This age requirement is established because Quikk provides access to services involving:
- Independent, unchaperoned passenger transportation dispatches across urban road environments;
- Commercial food preparation and retail delivery transactions;
- Age-restricted, regulated merchandise where legally permitted (such as alcoholic beverages, tobacco/cigarette products, certain pharmacy health items, and restricted adult-classified merchandise); and
- Independent financial commitments involving in-person physical cash settlement and fare obligations upon delivery or arrival.
Important Regulatory Notice: Attaining the age of 18 does not automatically make every transaction lawful. Specific statutory restrictions, local municipal bylaws, and product-specific licensing rules apply to regulated purchases under South Sudanese law [LEGAL REVIEW REQUIRED — SOUTH SUDAN].
Account Responsibilities
- Accurate Information: You agree to provide true, accurate, current, and complete personal and contact details during registration. Impersonation or the use of fictitious details is strictly prohibited.
- Account Security: You are responsible for safeguarding your login credentials and are solely responsible for all activities, bookings, and cash payments initiated under your account.
- One Account Per User: Each individual user, driver, or merchant entity may operate only one primary profile unless expressly authorized in writing by Quikk.
- No Delegation to Unaccompanied Minors: You may not permit individuals under 18 years of age to utilize your account to independently book rides or receive deliveries without active adult supervision.
2A. Regulated & Age-Restricted Goods Framework
Quikk maintains a clear three-tier regulatory categorization for all merchandise ordered, dispatched, transported, or delivered through the platform:
- Generally Permitted Goods: Ordinary prepared restaurant food, baked goods, groceries, non-alcoholic beverages, and everyday retail items.
- Age-Restricted / Regulated Goods: Products that may only be listed, sold, ordered, transported, or delivered where specifically permitted by applicable South Sudanese law and Quikk platform policy. These include:
- Alcoholic Beverages: Beer, wine, spirits, and liquor. Available only from licensed merchants to customers meeting applicable statutory legal purchase ages [LEGAL REVIEW REQUIRED — SOUTH SUDAN].
- Tobacco & Nicotine Products: Cigarettes, cigars, electronic vapor products, and loose tobacco. Available only where legally permitted to individuals satisfying applicable age thresholds.
- Medicines & Health Products: Permitted over-the-counter wellness supplies and licensed pharmacy products. Prescription-controlled medications are strictly governed and may not be listed or delivered without statutory licensing and pharmacist authorization [LEGAL REVIEW REQUIRED — PHARMACY/MEDICINE SALES].
- Adult/Age-Restricted Merchandise: Any merchandise classified by law or platform policy as requiring adult majority. Such goods may be offered only where lawful, sold by authorized merchants, approved by Quikk, and received by verified adult recipients.
- Prohibited Goods: Products whose sale, possession, or transportation is unlawful under South Sudanese law (including illicit narcotics, unlicensed firearms, ammunition, explosives, stolen property, and hazardous toxins). Quikk reserves the right to prohibit additional categories even if not prohibited by general statutory law.
Age & Identity Verification for Restricted Deliveries
For any order containing age-restricted or regulated merchandise:
- Mandatory Recipient Presence: Deliveries of restricted products cannot be left unattended or handed to an unverified proxy. The customer who placed the order must be physically present at delivery handoff.
- Evidence of Legal Age: Merchants and independent couriers have the strict right and legal obligation to request valid, unexpired government-issued photo identification (such as a National ID or Passport) confirming the recipient meets the statutory legal age before completing handoff.
- Mandatory Refusal & Order Cancellation: If the recipient cannot produce acceptable proof of legal age, appears visibly intoxicated, or cannot verify account ownership, the courier must refuse handoff. Refused orders will be handled according to platform procedures, and the customer remains responsible for associated cancellation and transport fees.
3. Nature of the Services
Quikk provides a communications and scheduling technology marketplace that connects customers seeking mobility transportation, parcel delivery, or restaurant food items with independent mobility providers (drivers and couriers) and participating local merchants (restaurants and retail shops).
Quikk is a technology provider and does not itself provide transportation, food preparation, or delivery services. Transportation is rendered by independent mobility providers, and food is prepared by independent partner kitchens. Quikk does not employ drivers, couriers, or restaurant personnel as direct employees, nor does Quikk own or operate commercial transport vehicles or commercial kitchens [LEGAL REVIEW REQUIRED].
4. Cash-First Transactions & Settlements
Quikk operates on a transparent, cash-first model for all launch transactions:
- Direct Cash Fares: For QuikkRide trips, passengers pay the driver the agreed cash fare directly upon arriving at the destination.
- Direct Cash for Food & Deliveries: For QuikkEats orders, customers pay the courier cash on delivery, or pay the merchant counter directly in cash for self-pickup orders.
- Upfront Estimates: Fare estimates and meal totals calculated in the application are provided upfront based on selected vehicle tier, estimated travel distance, and published merchant menu prices.
- Exact Currency: Users and drivers are encouraged to carry standard South Sudanese Pound (SSP) or accepted local currency denominations to facilitate accurate change handoffs.
- No Card or Electronic Refunds: Because all transactions are executed directly in cash between the participants, Quikk does not process card refunds or wallet chargebacks. Order discrepancies must be resolved directly at the point of exchange or reported to customer support for mediation.
5. Platform Roles & Responsibilities
- Customer Responsibilities: Arrive punctually at designated pickup points; treat drivers and couriers with dignity; pay the agreed cash total; ensure safe passenger conduct.
- Driver & Courier Responsibilities: Maintain valid regulatory licensing; operate clean, roadworthy vehicles; adhere to local traffic safety laws; wear helmets on motorbikes; deliver orders carefully; handle cash honestly.
- Merchant Responsibilities: Prepare ordered food under clean and hygienic standards; package items securely; ensure menu pricing accuracy; coordinate handoffs with couriers promptly.
6. Prohibited Conduct
Users, partners, and visitors may not engage in any activity that harms or undermines the Quikk community, as detailed in our Community & Acceptable Use Policy. Prohibited activities include:
- Creating fake ride requests, fictitious delivery orders, or false partner registrations.
- Harassment, threats, verbal abuse, violence, or discrimination toward any customer, driver, merchant, or Quikk staff member.
- Submitting fraudulent identity documents, altered driver licenses, or forged commercial permits.
- Manipulating GPS coordinates, simulating artificial ride distances, or spoofing telemetry data.
- Transporting illegal substances, unauthorized weapons, contraband, or hazardous materials.
7. Suspension & Termination
Quikk reserves the right to immediately suspend, restrict, or permanently terminate any user, driver, or merchant profile that violates these Terms, violates our Community Guidelines, or poses a safety risk to the public. Serious violations may be reported directly to local law enforcement authorities.
8. Intellectual Property
All brand logos, trademarks, website interfaces, mobile application designs, typography, codebases, and content across QuikkRide, QuikkEats, and QuikkBusiness are the proprietary intellectual property of Quikk and Rare Inc. You are granted a limited, revocable, non-exclusive, non-transferable license to access the Services solely for personal or authorized business use.
9. Disclaimers & Limitation of Liability
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUIKK AND RARE INC. EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
QUIKK DOES NOT GUARANTEE THAT A DRIVER WILL BE AVAILABLE AT ANY GIVEN TIME OR LOCATION, NOR DOES QUIKK WARRANT THE ACTIONS, CONDUCT, PUNCTUALITY, OR QUALITY OF INDEPENDENT DRIVERS, RIDERS, OR MERCHANTS. IN NO EVENT SHALL QUIKK OR RARE INC. BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICES.
10. Complaints & Incident Reporting
If you experience service discrepancies, unsafe driving, food quality concerns, or billing disagreements, you may file an incident report directly through the app support interface or by contacting our team at Support@rareincorporated.com. We investigate all formal complaints and take appropriate administrative action against offending accounts.
11. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws applicable in Juba, South Sudan, without regard to its conflict of law principles [LEGAL REVIEW REQUIRED]. Any legal action or dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts of Juba, South Sudan [LEGAL REVIEW REQUIRED].
12. Changes to Terms & Contact Information
We reserve the right to amend or update these Terms at any time. Material revisions will be indicated by updating the "Last Updated" and "Version" notations at the top of this document. Continued use of the Services after revisions constitutes your acceptance of the updated Terms.
